This document is an electronic record in terms of Information Technology Act, 2000 and published in accordance with the provisions of Rule 3 of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of SastaSauk marketplace platform – shop.slackroid.com (hereinafter referred to as “Platform”).

The Platform is owned by Slackroid, co-powered by Slackroid and registered subject to the provisions of the GST Act and rules.

Your use of SastaSauk and its services and tools are governed by the following terms and conditions (“Terms of Use”) as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. By mere use of the Platform, You shall be contracting with Slackroid, the owner of the Platform. These terms and conditions including the policies constitute Your binding obligations with SastaSauk.

For the purpose of these Terms of Use, wherever the context so requires “You” or “User” shall mean any natural or legal person who has agreed to become a buyer or seller on the Platform by providing Registration Data while registering on the Platform as Registered User using the computer systems. The term “We”, “Us”, “Our” shall mean Slackroid and its affiliates.

Amendment Provision:

SastaSauk continuously reviews and updates its Terms of Use to ensure they are current and effective. The latest version of these terms is always accessible on our website. SastaSauk has the authority to modify, amend, or overhaul any portion of these terms by posting the revisions on the platform. Such changes become effective immediately once they are published.

Users are encouraged to regularly visit the Terms of Use page to stay informed about any modifications. Your continued use of or access to the platform’s services or platform after changes are posted signifies your agreement to those updated or revised terms.

User Account, Password, and Security:

When you register for an account with SastaSauk, you are obliged to provide accurate, current, and complete information as prompted by the registration process. It is essential to maintain the accuracy of this information to ensure smooth transactions and communication on the platform.

Upon registering, you agree to accept responsibility for all activities that occur under your account. It is your duty to secure your account credentials and monitor account activity. Should any unauthorized use of your account occur or any other security breaches happen, you must inform SastaSauk immediately.

Maintaining the confidentiality of your password and any account details is your sole responsibility. SastaSauk will not be liable for losses caused by unauthorized use of your account; however, you could be held liable for losses to SastaSauk or others due to such unauthorized use.

If you fail to comply with these registration obligations, SastaSauk reserves the right to suspend or terminate your account without prior notice and at our discretion.

If your account remains inactive for a period of two years, SastaSauk will remove your data, including transactional records, from our systems, and you will lose access to this data.

Services Offered:

SastaSauk offers a variety of online services via its platform, enabling users to buy and sell original merchandise such as clothing, footwear, and accessories from a wide array of fashion and lifestyle brands, referred to here as “Products.” These products can be transacted using various payment methods available on the platform. The buying and selling processes are subject to detailed policies like cancellation, exchange, and return policies, details of which are available under the FAQ section on the platform and are integrated by reference into these Terms of Use.

When initiating a return, users must verify through a mandatory checkbox that the product is unused and retains its original tags to qualify for a return. If a returned product is found to be used, damaged, or missing its original tags, the return request will be rejected, and the product will be sent back to the user. In such cases, the user will not qualify for a refund, and SastaSauk disclaims any liability regarding the denial of such refunds. Additionally, if the user refuses to accept a reshipped product, they will forfeit their eligibility for a refund, and SastaSauk will not be responsible for any liabilities pertaining to the return or refund of the reshipped product. The Terms of Use may also be supplemented by conditions specific to certain products, which will be displayed alongside those products.

SastaSauk does not guarantee the accuracy, completeness, reliability, currency, or error-free nature of the product descriptions or any other content on the platform and will not be liable for any errors in this regard.

Both purchasing and selling services are provided through SastaSauk, facilitating a comprehensive marketplace experience for users.

Communications:

When you interact with SastaSauk via our platform, send us emails, or engage in other forms of communication, you are connecting with us through electronic records. By using the platform, you consent to receive communications from us through electronic records periodically and as needed. We may contact you through email or by other means of communication, whether electronic or otherwise.

Platform for Transactions and Communications

SastaSauk serves as a facilitate platform where buyers and sellers can engage in transactions. SastaSauk does not partake in or exert control over any transactions between platform users.

  • Commercial and Contractual Terms: These are solely established and agreed upon by the buyers and sellers. This includes, without limitation, pricing, shipping costs, payment methods, payment terms, delivery dates, periods, and modes, as well as warranties and after-sales services related to the products and services. SastaSauk does not influence or participate in the formulation or acceptance of these terms. All promotional discounts and offers are provided by the sellers or brands, not by SastaSauk.
  • Order Placement: An order placed by a buyer with a seller on SastaSauk constitutes an offer to purchase by the buyer. It should not be viewed as an acceptance of the offer by the seller. Sellers retain the right to cancel any order at their discretion, and buyers will be notified of such cancellations via email or SMS. In cases where orders are canceled by the seller, any transaction price paid by the buyer will be refunded.
  • Product and Service Representations: SastaSauk does not guarantee the quality, value, or sale-ability of any products or services listed for sale or purchase on the platform. We do not endorse any of the sales or purchases of products or services on the platform and accept no liability for any inaccuracies or omissions, whether on behalf of ourselves or third parties.
  • Performance and Disputes: SastaSauk is not liable for the performance of agreements between buyers and sellers nor will it mediate disputes between parties. We do not guarantee that transactions initiated on our platform will be completed nor do we verify the credentials of any of our users.
  • Ownership and Responsibilities: At no point does SastaSauk take possession, gain title to, or assume any rights or claims over the products offered by sellers on the platform. We do not have any obligations or liabilities concerning contracts made between buyers and sellers.

SastaSauk merely provides a platform enabling users to extend their reach to a larger audience for buying and selling products or services. The contract for sale of any product or service is strictly a bipartite agreement between the seller and the buyer.

At no point does SastaSauk possess any rights, title, or interests in the products listed on the platform, nor does SastaSauk bear any obligations or liabilities regarding transactions conducted between buyers and sellers.

SastaSauk is not liable for any dissatisfaction or delays in service, nor for any damages or delays arising from products being out of stock, unavailable, or on back order.

User Conduct and Rules on the Platform:

By engaging with the SastaSauk platform, you agree to adhere strictly to the following conduct guidelines:

  • Content Restrictions: You must not upload, post, host, or transmit any content that:
    • Is not rightfully yours or that you do not have permission to use.
    • Is harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of privacy, hateful, racially or ethnically objectionable, disparaging, inciting illegal activities, or is otherwise unlawful.
    • Is deceptive or misleading.
    • Constitutes “junk mail”, “spam”, “chain letters”, or unsolicited mass mailing.
    • Promotes or engages in illegal activities, abuse, threats, defamation, or libel.
    • Violates any third-party rights, including intellectual property, privacy, or publicity rights.
    • Contains restricted access pages, hidden images, or similar components not linked to/from accessible pages.
    • Instructs or encourages illegal activities such as unauthorized weapon creation, privacy violations, or virus creation.
    • Includes videos or images of another person without their explicit consent.
  • Prohibited Activities: You are prohibited from:
    • Gaining unauthorized access to SastaSauk’s data or user accounts.
    • Interfering with another user’s enjoyment of the platform.
    • Conducting fraudulent activities or engaging in behavior that leads to an unnecessary loss for SastaSauk or misuse of the platform’s services.
  • Transactional Integrity: Users should not:
    • Engage in activities that lead to an unreasonable load on infrastructure.
    • Engage in any activity that could result in financial loss or legal liability for SastaSauk or other users.
  • Account Misuse: Users should refrain from:
    • Misusing another user’s phone or email.
    • Providing incorrect or invalid addresses or contact details.
    • Abusing special discounts or promotional offers.
    • Participating in any deceptive practices.
    • Returning products that do not conform to the stated reasons for return.
  • Bulk Orders and Fraudulent Orders: SastaSauk reserves the right to cancel orders that are deemed to be ‘Bulk’ or ‘Fraudulent’ in nature based on certain criteria which may include:
    • Orders not meant for personal use but for commercial resale.
    • Multiple orders for the same product at the same address which exceeds an individual’s reasonable needs.
    • Orders that are placed using technological glitches.
  • Legal Compliance: You must ensure full compliance with all applicable laws, including but not limited to, those pertaining to e-commerce, data protection, and consumer protection. This includes ensuring all product or service descriptions are accurate and not misleading.
  • Content Responsibility: The content posted on the platform does not necessarily reflect the views of SastaSauk. SastaSauk is not responsible for, and does not endorse, the content users post. You are responsible for ensuring that your content is legal, and does not infringe on any rights.
  • By using SastaSauk, you acknowledge and agree to these rules and guidelines, understanding that violation could lead to the termination of your access to the platform.
  • SastaSauk does not guarantee the exact accuracy regarding the finish, appearance, size, color, or other physical aspects of the products as presented online. The actual product delivered may vary slightly. Our Return & Exchange Policy allows you the flexibility to return or exchange items purchased from SastaSauk within the specified period detailed on the product’s detail page. GST Registration Requirement for Platform Transactions:

On SastaSauk, it is not mandatory for users to be registered under the Central or State Goods and Services Tax Legislation (“GST Laws”) to conduct transactions on the platform. However, the responsibility for compliance with all GST Laws and other applicable tax laws rests solely with the user. SastaSauk does not bear any direct or indirect tax obligations that may arise from a user’s activities on the platform. Users are advised to independently assess their tax responsibilities and determine whether they are required to register for GST or comply with other tax obligations. Independent tax advice is recommended to understand the implications of business transactions conducted through SastaSauk.

Disclaimer: Pricing and Liability

Please note that the pricing of products listed on SastaSauk may be subject to inaccuracies due to technical issues, typographical errors, or incorrect product information provided by sellers. In such cases, the seller reserves the right to cancel any affected orders.

You agree to release and hold harmless SastaSauk and/or any of its officers and representatives from any liabilities, costs, damages, or consequences arising from the actions of users on the platform. While SastaSauk makes reasonable efforts to verify the information provided by users, it cannot guarantee the accuracy, completeness, or quality of information posted by other users. This may include information that you find offensive, misleading, or deceptive. Please exercise caution and engage in safe trading practices when interacting with other users.

Be aware of the risks involved in dealing with minors or individuals acting under false pretenses.

Charges:

SastaSauk may impose a nominal fee for browsing and purchasing on the platform. We reserve the right to alter our Fee Policy at any time, which may include introducing charges for new services or modifying charges for existing services. Any changes to the Fee Policy will be promptly posted on the platform and will become effective immediately upon posting. All fees will be denominated in Indian Rupees, and you are responsible for complying with all applicable laws, including those in India, regarding payments to SastaSauk.

Platform Fee and Refund Policies

The platform fee on SastaSauk is a charge designed to support the maintenance and continuous improvement of the platform, ensuring a seamless and efficient user experience.

Refund of Platform Fee:

  1. Complete Order Refund:
    • If an order is lost or not delivered to the specified location, and if the payment was made online, the entire order amount including the platform fee will be refunded.
  2. Partial Order Cancellation or Return:
    • If a customer cancels part of an order or returns an item, the platform fee associated with that specific item will be refunded proportionately.
  3. Full Order Cancellation:
    • In cases where a customer cancels the entire order, all platform charges will be refunded.

Seller Guidelines:

  1. As a registered seller on SastaSauk, you are permitted to list items for sale according to the platform’s policies, which are an integral part of these Terms of Use. It is imperative that you have the legal right to sell the items you list. Ensure that your listings do not violate any intellectual property, trade secrets, or other proprietary rights, including privacy and publicity rights of third parties.
  2. Listings should accurately describe the items and must include text, graphics, and pictures that accurately represent the items for sale. Each item should be placed in the appropriate category on the platform, and you must maintain sufficient stock to fulfill sales successfully. The description should honestly reflect the actual condition of the product, and if discrepancies arise between the described and actual conditions, you are obligated to refund any payments received from buyers.
  3. You are prohibited from listing the same product in multiple quantities across various categories. SastaSauk reserves the right to remove such multiple listings.

Payment Terms:

General Payment Liability: When you utilize any of the payment methods available on SastaSauk, we are not liable for any loss or damage that may arise directly or indirectly due to:

  • Lack of authorization for any transaction.
  • Transactions exceeding the preset limits agreed upon by you and your bank.
  • Any payment issues arising from the transaction.
  • Decline of transaction for any reason.

Currency and Transaction Compliance: All payments on the platform must be made in Indian Rupees, which is the only currency accepted by SastaSauk for transactions within the Republic of India. We do not support transactions in any other currency on our platform.

Verification for Secure Transactions: Prior to shipping or delivering your order, the seller may require you to provide supporting documents such as government-issued ID and address proof to verify the ownership of the payment instrument used for your purchase. This measure is implemented to maintain a secure online shopping environment for our users.

Transaction and Commercial Terms: The transaction price and all commercial terms such as delivery and dispatch of products or services are based on agreements directly between the buyer and seller (principal to principal). The payment facility on SastaSauk merely facilitates these transactions but does not hold any responsibility for issues such as non-delivery, non-receipt, non-payment, damage, breach of representations and warranties, non-provision of after-sales or warranty services, or any fraudulent activities related to the products or services listed.

Authorization and Payment Processing: You explicitly authorize SastaSauk or its service providers to collect, process, facilitate, and remit payments electronically or through Cash on Delivery between users in relation to transactions on the platform. SastaSauk operates on a principal to principal basis and is an independent contractor for all purposes. It does not control or assume liability for the products or services that are paid for through its payment facility. We do not guarantee the identity of any user nor the completion of any transaction.

Facilitator Role: The payment facility provided by SastaSauk is not a banking or financial service but merely acts as a facilitator providing an automated online electronic payment, receipt, and remittance service, utilizing the existing authorized banking infrastructure and credit card payment gateway networks. By offering this payment facility, SastaSauk is not acting as a trustee or fiduciary with respect to the transactions or transaction price.

Payment Facility for Buyers on SastaSauk:

Legal Binding and Transaction Initiation: As a buyer on SastaSauk, when you initiate a transaction, you are entering into a legally binding contract with the seller to purchase their products or services using our Payment Facility. You are obligated to pay the Transaction Price through your issuing bank to the seller as per the terms of the Payment Facility.

Communication and Amendments in Transaction: You may negotiate changes in dispatch or delivery times with the seller using electronic communication and automated features provided by the Payment Facility. Any changes or extensions in delivery timelines must comply with the Payment Facility’s rules and policies.

Notification of Delivery or Non-Delivery: You must electronically notify the Payment Facility through the appropriate features on SastaSauk immediately upon receipt or non-receipt of the product within the specified period as outlined in our policies. Failure to notify within this period will be regarded as acceptance of the product, applicable to all transactions including Cash On Delivery.

Refund Policy: You are entitled to a refund of the Transaction Price if you do not receive the product within the agreed time-frame or within the policy’s specified period, whichever is earlier. However, if you fail to claim a refund in the stipulated time-frame using the platform’s features, you will become ineligible for a refund.

Availability of Payment Facility: The Payment Facility may not be fully available for certain types of products, services, or transactions as specified in our policies. Consequently, you may not be entitled to a refund for transactions involving these specific categories.

Refund Processing:

  • For non-Cash On Delivery transactions, refunds will be processed back to the same issuing bank from which the transaction price was originally received, or through any other method available on SastaSauk, as chosen by you.
  • For Cash On Delivery transactions, refunds will be processed via electronic payment transfers.

Currency and Refund Amount: All refunds will be processed in Indian Rupees and will match the Transaction Price received in Indian Rupees. Refunds through electronic payments will be made using paytm, google pay or any other online banking/electronic funds transfer system approved by the Reserve Bank of India (RBI).

Bank Support for Refunds: Refunds may be supported for select banks only. If your bank is not supported, you will need to provide alternative bank account details for the refund process.

Conditional Refunds: Refunds are conditional and subject to SastaSauk’s recourse in the event of misuse by the buyer. We may also request additional documents for verification.

Policy Compliance: Refunds are subject to your compliance with our policies.

Transaction Limits: SastaSauk reserves the right to impose limits on the number of transactions or the transaction price we may receive from an individual’s valid credit/debit card, bank account, or other financial instruments. We also reserve the right to refuse processing transactions that exceed these limits.

Security Checks: SastaSauk may conduct security checks and has the discretion to refuse processing transactions if the buyer’s credibility or the genuineness of the transaction is in question.

Delay in Payment Confirmation: If suspicious or in cases of high transaction volumes, SastaSauk may delay payment confirmations to ensure transaction safety. Additionally, we may withhold informing sellers to dispatch or remit transaction price if required by law enforcement or if the buyer engages in illegal activities.

Liability for Transaction Delays: SastaSauk will not be liable for any damages or claims resulting from unprocessed transactions or delays that are beyond our control.Top of Form

Compliance with Legal Requirements on SastaSauk:

PAN Card Submission for High-Value Purchases: In compliance with applicable laws, if a customer makes a purchase totaling INR 200,000 or more, they are required to upload a scanned copy of their PAN card to the platform within four days of the purchase. This requirement is a one-time obligation per customer unless there is a discrepancy in the name on the account and the PAN card, in which case the order will be cancelled.

Adherence to Applicable Laws: Both buyers and sellers on SastaSauk must comply with all relevant Indian laws, including but not limited to the Foreign Exchange Management Act (FEMA) 1999, Customs Act, Information Technology Act 2000 and its amendments, Prevention of Money Laundering Act 2002, Foreign Contribution Regulation Act 1976, Income Tax Act 1961, and the Export-Import Policy of the Government of India. These laws govern the use of the payment facility and overall transactions on the SastaSauk platform.

Buyer’s Financial Arrangements:

  • Credit/Debit Cards and Other Payment Instruments: Transactions using valid credit/debit cards or other payment instruments are processed through the respective card’s payment gateway or the appropriate payment system infrastructure. The terms and conditions agreed upon between the buyer and the issuing bank or payment instrument company govern these transactions.
  • Online Bank Transfers: Transactions involving online bank transfers from valid bank accounts utilize gateways provided by the respective issuing banks supporting SastaSauk’s payment facilities. Such transactions are also subject to the terms and conditions agreed upon between the buyer and the respective issuing bank.

Customer Conduct and Interactions with Delivery Partners

Terms of Engagement:

A) Diversity and Inclusion: SastaSauk is committed to promoting diversity, inclusion, and equity. We ensure that all individuals, including our delivery partners, are protected from discrimination based on race, social origin, caste, ethnicity, nationality, gender, gender identity and expression, sexual orientation, disability, religion, belief, age, or any other grounds.

B) Non-Discrimination Policy: SastaSauk strictly prohibits any form of discrimination against delivery partners. Discrimination on the basis of race, religion, caste, place of origin, disability, sexual orientation, sex, marital status, gender identity, age, or any other characteristic protected under applicable law is not tolerated.

C) Platform Access: SastaSauk reserves the right to restrict or withhold access to the platform if a customer behaves in a manner that is disrespectful, discourteous, abusive, or otherwise inappropriate or unlawful towards any delivery partner associated with SastaSauk.

D) Expectations from Customers: Customers are expected to treat all delivery partners with the utmost courtesy and respect. This ensures a positive and professional environment for all parties involved in the transaction process on SastaSauk.

Replacement Guarantee:

Replacement Guarantee aims to support buyers who encounter issues with products purchased from verified sellers on the platform. The duration of the Replacement Guarantee varies depending on the product category and the seller. Please refer to our website to view the specific return policy applicable to different categories. Should a defect be discovered at the time of delivery or within the specified return policy period, buyers are entitled to request a replacement of the product(s) under the following conditions:

  1. Defect Notification:
    • Buyers must notify the seller of any defects in the product(s) at the time of delivery or within the applicable return policy period. A replacement will be provided for the defective product(s).
  2. Partial or Full Replacement:
    • The replacement may be for the entire product(s) or part(s) thereof, depending on the availability with the seller.

Products Not Eligible for Return or Replacement:

  • Products damaged through misuse or incidental damage due to malfunctioning.
  • Consumable items that have been used or installed.
  • Products with tampered or missing barcode.
  • Digital products/services.
  • Products with damages or defects not covered under the manufacturer’s warranty.
  • Products returned without all original packaging and accessories, including the box, any manufacturer’s packaging, and all other items originally included with the product(s) delivered.

Clothing and Footwear Exchange Policy

3-Day Exchange on Clothing and Footwear: SastaSauk offers a 3-day exchange policy for clothing and footwear purchased from qualified sellers, subject to the following conditions:

  • Condition of Items: Clothing and footwear must not be used (other than for trial), altered, washed, soiled, or damaged in any way.
  • Packaging and Tags: Original tags must be intact, and items must be returned in their original packaging. For items that come in branded packaging, the box should remain undamaged.
  • Exclusions: Returns are not applicable for innerwear, lingerie, socks, and any freebies included with clothing items.

3-Day Replacement Guarantee for Lifestyle Products: Damaged or defective products, or products not as described in the Lifestyle category (which includes clothing, footwear, etc.), are covered by a 3-day replacement guarantee. Fraud Prevention Measures: If SastaSauk suspects or determines that any buyers or sellers are involved in activities intended to provide false or misleading claims or information, we reserve the right to take the following actions:

  • Account Suspension: Suspend, block, or cancel the display name of such buyers and sellers.
  • Disqualification from Program: Disqualify the implicated users and any related users from availing protection through this program.
  • Legal Actions: Initiate civil and/or criminal proceedings against individuals filing invalid, false claims, or providing false, incomplete, or misleading information.
  • Prosecution: Users who knowingly and intentionally provide fraudulent information may face criminal prosecution.
  • Commitment to Fair Practices: SastaSauk is committed to maintaining a fair and safe trading environment. Customers involved in any suspicious or fraudulent activities will not be permitted to return products and may face further restrictions on their accounts.

Indemnity: You agree to indemnify, defend, and hold harmless SastaSauk, its parent company, licensees, affiliates, subsidiaries, group companies, and their respective officers, directors, agents, and employees from any and all claims, demands, actions, costs, liabilities, losses, and damages of any kind (including legal fees) resulting from your breach of these Terms of Use, Privacy Policy, or any other policies, your violation of any law or the rights of a third party, or any unauthorized, illegal, or negligent use of the SastaSauk platform by you or conducted through your account. This indemnity applies to and covers any accusations, liabilities, or expenses arising from any breach or alleged breach of the terms of this Agreement, including any claim of infringement or violation of any intellectual property rights, other rights, or privacy rights.

Miscellaneous Provisions Applicable to the SastaSauk Agreement

  • Governing Law and Jurisdiction: This Agreement is governed by the laws of India. Any legal proceedings arising under or related to this Agreement or the Platform shall be subject to the exclusive jurisdiction of the courts located in Bangalore, India.
  • Assignment of Rights: SastaSauk reserves the right to assign its obligations and rights under this Agreement to any third party without prior notice or consent.
  • Non-Waiver: The failure of SastaSauk to exercise or enforce any right or provision of this Agreement does not constitute a waiver of such right or provision. Any waiver of any provision of this Agreement will be effective only if in writing and signed by SastaSauk.
  • Platform Operation: The Platform is controlled and operated from within India, and SastaSauk makes no representation that the Platform’s content, information, or materials are appropriate or available for use in other locations. Accessing the Platform from territories where its content is illegal is prohibited. Users accessing the Platform from outside India do so on their own initiative and are responsible for compliance with local laws. The User agrees to release SastaSauk from any liability resulting from such unauthorized use.
  • Changes to Platform and Services: SastaSauk reserves the right to introduce new features, functionalities, and components to the Platform and/or to change, alter, modify, suspend, discontinue, or remove existing ones without prior notice to users. Furthermore, SastaSauk has the right to discontinue permanently or temporarily any of the services provided, terminate the Platform, or start charging for services that were previously free, at its sole discretion without prior notice to users.
